MINISTER OF TRADE'S REGULATION ON IMPORTER IDENTITY NUMBER (API)
The Minister of Trade issued, on September 16, 2009, her Regulation Number 45/M-DAG/PER/9/2009 concerning Importer Identity Number (generally known by its Indonesian acronym API, short for Angka Pengenal Importir).
Under this regulation (“Regulation 45/2009), importation activities may only be conducted by importers that have an API. The API comprises General Importer Identity Number (API-U) and Producer Importer Identity Number (API-P), the former for importers whose imports are for the purposes of their trading business activities and the latter for importers whose imports are for own purposes and/or to support their production activities.
Article 7 of Regulation 45/2009 lists: (i) goods for which the importation may be executed without an API, such as temporarily imported goods and promotional goods; and (ii) importation activities that do not require an API. For importation of goods without API, the prior approval of the Director of Imports of the Department of Trade is required.
The remaining provisions of Regulation 45/2009 concern, among others, the API application procedures, the responsibilities and obligations of API holders, and sanctions for violations of the rules and regulations.
