In the industrial-projects arena, he is counsel to Inalum (an Indonesian state-owned alumina producer that was appointed the holding company for all state-owned mining enterprises in 2017), which together with Antam (another Indonesian state-owned mining company) and PT Borneo Alumina Indonesia (project company owned by Inalum and Antam), is developing a smelter-grade alumina refinery in Mempawah (West Kalimantan Province) as a joint venture between Inalum, Antam and the world’s second largest alumina producer, Aluminum Corporation of China Ltd. (Chalco). Phase 1 of the project involves an investment of approx. USD 1 billion, with a further USD 2 billion expected to be invested during the second phase over the next 5 years.
In real estate, Herry recently completed work on the assignment of land assets from the Asahan Authority (a state industrial development authority) to Inalum – this was a monumental project involving the transfer of titles to over 1,200 hectares of land following the government’s decision to dissolve the Asahan Development Authority.
In restructuring & insolvency, he has worked on a long list of major bankruptcy and debt restructuring matters down the years, including acting for major vessel-lessor creditors in the court-sanctioned debt-restructurings (PKPU) of PT Berlian Laju Tanker Tbk; representing various individual and corporate creditors in the bankruptcy proceedings of PT Polysindo Eka Perkasa Tbk; assisting various Indonesian banks creditors in the bankruptcy process of N.V. De Indonesische Overzeese Bank / Indover Bank in the Netherlands; advising a creditor on the implementation of the ratified composition plan arising from the PKPU proceedings of PT Toba Pulp Lestari Tbk; representing a major bank creditor in the second PKPU proceedings of PT Davomas Abadi, Tbk; advising a major lender on the termination of bankruptcy proceedings against PT Dharmala Agrifood; representing a corporate creditor in the PT Metro Batavia insolvency; representing creditors in the PKPU process of coal mining company PT Asmin Koalindo Tuhup; and acting for the creditors in the PKPU of oil and gas company PT Apexindo Pratama Duta Tbk.
